Purchasing a NAB Visa Gift Card

Cards can be purchased from any NAB branch. No identification is required to purchase a Card, and there is no minimum age.

Information You need to know:
The following information is provided to assist You to understand some important things about Your NAB Visa Gift Card. However the terms and conditions in this brochure govern the Use of Your Card and should be read before purchasing or using the Card.

  • the Card should be treated like cash and cannot be replaced if lost or stolen. The remaining value will not be refunded;
  • changes to the terms and conditions in this brochure will not be sent to You personally because NAB does not collect Your details when a Card is purchased. Please refer to the Changes and Notices section of the terms and conditions. Current terms and conditions will appear on the NAB website nab.com.au/yourgiftcard or are available from any NAB branch;
  • Expiry Date – the Card will expire at the end of the month shown on the Card face. At that time any remaining value on the Card will be forfeited to NAB;
  • the Purchaser must ensure that the Cardholder is made aware of the terms and conditions in this brochure, and is responsible for any Use of the Card:
  • When making a purchase from a Merchant the “Credit” button should always be selected;
  • Balance Enquiry and Transaction History Enquiry charges can be avoided by maintaining a list of transactions. The ledger provided on the back of the Card will assist;
  • transaction declined – if there is insufficient value or balance to cover a purchase the transaction will be declined.

Terms & Conditions


NAB Visa Gift Card

These terms and conditions apply to the Use and operation of Your NAB Visa Gift Card. It is important that You read them carefully and keep them for future reference. These terms and conditions may be:
• viewed by visiting NAB’s website at nab.com.au/yourgiftcard, or
• obtained from any NAB branch.

Definitions
In these terms and conditions:
Activate means the activation of the Card by NAB to enable You to Use the Card;
Balance Enquiry Service means the service made available by NAB for You to enquire about the Card Balance and transaction history (the last five (5) transactions). Contact details are included in the General Information section of this brochure. This service is also available from a NAB branch;
Business Day means a day other than a Saturday or Sunday or a day designated as a public holiday throughout Australia;
Card means a prepaid NAB Visa Gift Card and any replacement Card issued by NAB when a Card is damaged;
Card Balance means at any time the amount of available value on a Card for Use in accordance with these terms and conditions;
Card Details means Your Card number and the Expiry Date shown on Your Card;
Cardholder means the person who uses the Card;
Card Value means the amount initially loaded onto a Card for Use in accordance with these terms and conditions;
Expiry Date means the month and year (MM/YY) shown on the Card, which will be at least 12 months after the Card is issued;
Fees and Charges means the Fees and Charges section of these terms and conditions;
Merchant means a provider of goods or services and who accepts payment by Use of the Card;
Purchaser means the person who purchased the Card;
Unauthorised Transactions means any transaction made without Your knowledge or consent;
Use means Use of the Card including providing the Card Details to a Merchant by telephone or the internet, or nominating the Card Details in a mail order or other authority to the Merchant;
We, Us, Our, NAB means National Australia Bank Limited ABN 12 004 044 937;
You, Your means a person who uses a Card and may be the Purchaser or the Cardholder.

These Terms and Conditions

These terms and conditions are accepted:
• by the Purchaser when they purchase the Card; and
• by the Cardholder when they first Use the Card.

These terms and conditions are the only terms and conditions applicable to the Use and operation of the Card. You should disregard any representation, warranty or statement which may be made in connection with the terms and conditions by any Merchant, its employees, agents or contractors where Your Card is being used to purchase goods and services from that Merchant.

Cards
Your Card:
• remains the property of NAB;
• expires on the last day of the month shown as the Expiry Date on the face of the Card;
• cannot be used after it has expired or has been replaced; and
• is not issued with a PIN.

Card Security
You should:
• keep Your Card in a safe place and provide reasonable protection from theft of the Card;
• not interfere with any magnetic stripe on the Card;
• comply with any reasonable instructions NAB provides about Card security;
• carry Your Card with You whenever You can; and
• regularly check that You still have the Card.

The Cardholder should sign the Card immediately when it is received and before Use.

Purchase of a Card
The Purchaser must ensure that the Cardholder is given these terms and conditions. NAB will Activate the Card when the Card is purchased.

Load of Value
At the time of purchase NAB will only load value onto a Card once at the request of the Purchaser. This is called the Card Value. Cards are not re-loadable.

All Cards must be loaded with a minimum Card Value of AUD $25 and a maximum Card Value of AUD $800.

The Card Value will be:
• reduced by the purchase of goods and services from Merchants using the Card or Card Details;
• reduced by applicable Fees and Charges;
• increased by processing a Merchant purchase refund;
• increased by NAB in the event NAB determines an amount was loaded onto the Card which was less than the amount requested and purchased by the Purchaser. This error will be corrected by NAB within 3 business days of the purchase of the Card; and
• decreased by NAB in the event NAB determines an amount was loaded onto the Card which was greater than the amount requested and purchased by the Purchaser. This error will be corrected by NAB within 3 business days of the purchase of the Card.

Use of a Card
Generally
Upon receipt of the Card and before Use, the Cardholder must sign the back of the Card in the signature panel.

You can make one or multiple purchases before the Card’s Expiry Date, provided the total amount of all purchases does not exceed the Card Balance.

The Card is only valid for Use until the end of the month shown on the Card face as the Expiry Date. At that time, the Card will expire and any remaining Card Balance will be forfeited to NAB.

Any expired Card should be destroyed by cutting it in half and disposing of it securely.

The Use of a Card is an unchangeable order by the Cardholder to NAB to process the transaction. A Cardholder cannot request NAB to alter or stop payment on the transaction.

The Card must not be used for any unlawful purpose including the purchase of any goods or services prohibited by law in Your jurisdiction. If NAB identifies any suspicious transaction activity, NAB may suspend the Card while investigations are carried out.

You cannot Use the Card:
• to obtain cash;
• at automatic fuel dispensers;
• to purchase gambling or gambling products or services from a Merchant;
• where there is no Card Balance;
• to transfer the Card Balance to any account or card; or
• in connection with any recurring payments (ie direct debit or periodical payment) arrangement.

 At a Merchant
Cards can be used at Merchants in Australia and most overseas countries where Visa cards are accepted and processed electronically.

This includes mail order and telephone orders. This does not mean that all goods and services available at those Merchants may be purchased by Use of a Card.

NAB is not liable for the refusal of any Merchant to accept or honour a Card or Card Details.

The display of Visa card promotional material at any business premises is not a warranty by NAB or by Merchants operating a business on those premises that all goods and services available at those premises may be purchased with Your Card.

When making a purchase from a Merchant You should always select the “Credit” button and review, sign and keep all receipts.

Subject to any applicable law, NAB is not responsible for goods or services supplied to You and any complaint must be resolved directly with the Merchant.

Use of the Card to make foreign currency transactions

If Your Card or Card Details are used to make transactions in a foreign currency, the amounts are converted to Australian dollars for adjustment to Your Card Balance as set out below:

• purchases, refunds and any other charges, incurred in currencies other than Australian dollars, are converted to Australian dollars (directly from United States, Canadian, New Zealand and Singapore dollars, Pounds Sterling, Euros and Japanese yen or, if in a currency other than these currencies, first to United States dollars) as at the dates they are processed by Visa International using exchange rates determined by them;
• the exchange rates used by Visa International to convert a foreign currency transaction to Australian dollars are wholesale market rates selected by Visa International from within a range of wholesale rates or the government mandated rate, in effect one day prior to the Visa International Central Processing Date. The converted Australian dollar amount appears in Your transaction history as the transaction amount; and
• a foreign currency transaction fee is charged to Your Card for foreign currency purchases.

(Note: Refunds incurred in currencies other than Australian dollars are converted to Australian dollars as at the date they are processed by Visa International using exchange rates determined by them. This often results in the refund being converted using an exchange rate different from the one used to convert the original purchase.)

Transaction Information
No statement is provided for Your Card. You should ensure that the transaction amount is correct before You sign receipts or transaction records given to You by Merchants.

By signing a receipt or transaction record You indicate Your agreement that the transaction amount is correct and that the amount shown is sufficient evidence of the cash price of the goods or services to which the receipt or transaction record relates.

You are encouraged to keep a list of transactions. You can Use the ledger provided on the back of the Card to assist You with this.

You may obtain information about the Card Balance and a list of Your transaction history (the last 5 transactions) using the Balance Enquiry Service. Information obtained will be provided in Australian dollars. A fee will be charged for making an enquiry using this service and is detailed in the Fees and Charges.

Information relating to Your Card Details and transaction details may be processed by Visa International in countries other than Australia. By using Your Card You agree that this transaction information may be processed outside Australia.

Transaction Authorisation
Purchase transactions need to be authorised by NAB before they can proceed. The Merchant or any other person involved in the transaction will obtain authorisation for the transaction prior to it being completed. NAB will not authorise a transaction if the Card Balance is less than the amount of the transaction.

NAB reserves the right to decline an authorisation for any transaction using the Card.

The Card Balance is reduced once authorisation is obtained. The Card Balance may continue to be reduced for up to 7 business days after the authorisation is obtained, if the purchase or other transaction is not completed.

Restaurants will seek authorisation for an additional amount of up to 15% above the purchase price to cover tips or other costs without the need to process an additional transaction; if the Card Balance is not sufficient to cover these additional amounts, then Your purchase transaction will be declined. However, with the Merchant’s agreement, You can pay the required amount if You know the exact Card Balance using the Card and an alternative payment source (eg cash or credit card).

Liability
Allowing others to Use the Card
You are responsible for any transaction using the Card or Card Details or any other Use of the Card.

The Purchaser should ensure that any person who receives the Card from the Purchaser or is otherwise nominated to Use the Card by the Purchaser receives a copy of these terms and conditions. That person should read and understand these terms and conditions.

Liability for Unauthorised Transactions
The Cardholder is responsible for the Use and safety of the Card and all transactions using the Card and Card Details except to the extent there has been fraudulent or negligent conduct by any NAB employees, agents or service providers.

Card Cancellation
The Purchaser can only cancel a Card at the time of purchase in the event of an error in the value load entered, or if they no longer wish to purchase a Card. In the event the Card is cancelled due to a value load error, a replacement Card with the correct details will be issued, and the funds transferred to the replacement Card.

NAB may only cancel the Card at the time of purchase if an error in value load was entered, or an incorrect value added.In this event a replacement Card will be issued and the funds transferred to the replacement Card.

The Cardholder cannot cancel a Card at any other time.

Fees and Charges
The following Fees and Charges apply in connection with the Use of the Card. Unless otherwise agreed with You the fees will be deducted from the Card Balance at the time You request the particular transaction. All fees are exclusive of GST as GST does not apply.

Visa International charges NAB 1.00% of the Australian dollar transaction amount for converting foreign currency transactions made with Cards into Australian dollars. NAB passes this fee onto You as part of the Foreign Currency Transaction Fee.

The above Fees and Charges are subject to change. NAB may also impose new Fees and Charges in connection with the Card or Your Use of the Card. NAB may waive or defer the payment of any Fees and Charges.

Subject to any applicable laws NAB may deduct from the available Card Balance the amount of any government charges and duties charged upon or in relation to the Use of the Card or transactions deducted from the available Card Balance, whether or not You are primarily liable for such duties, taxes, rates or charges. Information on Fees and Charges currently applying to Your Card is available online at nab.com.au/yourgiftcard.

Lost, stolen or damaged cards
Lost or Stolen Cards
The Card should be treated like cash, and cannot be replaced if lost or stolen. Any remaining Card Balance will not be refunded.

Damaged Cards
Should Your Card be damaged while in Australia and You wish to replace it, You will need to take the damaged Card to any NAB branch and purchase a replacement Card. Your replacement Card will be loaded with the remaining Card Balance. A fee will apply for this service – see the Fees and Charges section. Damaged cards cannot be replaced while You are overseas.

Disputed transactions, queries or complaints

Should You have a disputed transaction in regards to Your Card, please contact Your local NAB branch. A disputed transaction may include:
• an unauthorised Card transaction – a transaction which You believe was not authorised by Use of Your Card; and
• a general dispute – a transaction which You wish to dispute. This may include a transaction which has been processed to Your Card more than once, or a transaction which was authorised by the Use of Your Card which You wish to dispute.

Despite notifying NAB of a disputed transaction You remain liable for any purchase made by using Your Card.

Notification procedure for disputed transactions
You should immediately notify NAB of any disputed transaction via a NAB branch. NAB recommends that You promptly read each receipt carefully as soon as You receive it. If applicable You may also wish to check Your transaction history using the Balance Enquiry Service. A fee applies for this service – see the Fees and Charges section.

You will be required to complete and submit a Prepaid Card Disputed Transaction Advice and to present Your Card. Your Card must be sighted by an authorised NAB staff member in order for Your disputed transaction form to be processed.

A fee is charged where the result of the investigation is not in Your favour – see Fees and Charges section.

Chargeback rights
This ‘chargeback right’ does not apply to transactions at EFTPOS terminals accessing Your Card using the “Savings” or “Cheque” option. Always select the “Credit” option when using Your Card.

The Visa card scheme has a dispute resolution process that is contained in its operating rules. This process allows NAB to dispute transactions on Your behalf in specific circumstances and timeframes and to claim a refund. This is referred to as a ‘chargeback right’.

For this reason, it is in Your interest to report any disputed transaction to NAB immediately and certainly no later than 75 days after the transaction date shown on Your receipt, or other transaction history (for transactions without a receipt). Otherwise the ability of NAB to dispute the transaction on Your behalf may be lost.

Where it can be shown that You have unreasonably delayed notifying NAB, You may be liable for the loss on any disputed transaction. The timeframes for NAB to process a chargeback vary between 75 calendar days and 120 calendar days depending on the type of disputed transaction.

NAB will not accept a refusal of a chargeback by a Merchant’s financial institution unless it is consistent with the relevant Visa scheme rules.

While Your dispute is being investigated by NAB, the value of the disputed transaction will be withheld against Your Card Balance until the dispute is resolved. You are able to access any remaining Card Balance while the matter
is being investigated. If Your Card expires while the matter is being investigated, the investigation will continue. Where the result of the investigation is in Your favour, the funds will be forwarded to You by Bank Cheque. Where the result of the investigation is not in Your favour, there would be no change to the Card Balance as per the usual Visa scheme process.

If You subsequently feel that an issue has not been resolved to your satisfaction, You may be able to raise your concerns with the Banking and Financial Services Ombudsman.

Changes and Notices
NAB may change these terms and conditions at its discretion at any time. Because You are using the Card anonymously You will not receive personal notification of changes. However, in the event NAB introduces a new fee or charge notification will be made available at nab.com.au/yourgiftcard.

Other changes will be notified through advertisement in a major newspaper no later than the day on which the change takes effect. Changes will also be made available at nab.com.au/yourgiftcard.

Privacy
Except in the case of a dispute NAB does not collect any personal information on the Purchaser or Cardholder. The Card is provided for Use anonymously. If You dispute a transaction made using the Card, we may collect certain personal information about You. That information will be used for the purposes of resolving Your dispute and may be disclosed to Our contractors and other service providers who may be outside Australia.

Governing law
These terms and conditions and the transactions contemplated by these terms and conditions are governed by the law in force in Victoria and each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of those courts.

Code of Banking Practice
NAB has adopted the Code of Banking Practice and relevant provisions of the Code apply to the Card and services included in this booklet, if You are an individual or a small business customer (as defined by the Code).

You can obtain from NAB upon request information on NAB’s standard Fees and Charges relating to the Card included in these terms and conditions, and general descriptive information referred to in the Code (13.1) by obtaining a copy of the Code from NAB at any NAB branch. This includes information on NAB’s obligations regarding the confidentiality of Your information, complaint handling procedures, bank cheques and the importance of You reading the terms and conditions applying to each banking service NAB provides to You.
