Conditions of Entry:
Definitions
"Beinteractive" means Beinteractive Pty Ltd ABN 75 058 774 593.
"Cash Advance" has the meaning given in the NAB Qantas Credit Card Account Terms and Conditions.
"Competition Term" has the meaning given in clause 2.
"Eligible Entrant" means an Australian resident aged over 18 who:
- holds a NAB Account;
- has been issued Promotional Material with their NAB Qantas Gold American Express Card; and
- is not:
- an officer or employee of the Promoter, Beinteractive or any of their respective related bodies corporate; or
- an immediate family member of any person referred to in paragraph (i).
"Eligible Purchase", for an Eligible Entrant, means any Purchase made using a NAB Qantas Gold American Express Card during that Eligible Entrant's Promotional Period, and which is debited to the Eligible Entrant's NAB Account no later than 5 days after that Promotional Period has ended, but does not include:
- Cash Advances (which include bills paid over the counter at NAB branches, financial institutions or a post office and the purchase of travellers cheques);
- balance transfers;
- fees and charges under the NAB account;
- interest charges;
- government fees and charges;
- unauthorised purchases for which the relevant Eligible Entrant is not liable;
- purchases the Promoter decides are wholly or partly for a business purpose; or
- where the NAB Qantas Gold American Express Card is used as a debit card to access linked accounts.
"NAB Account" means the NAB Qantas Gold credit card account held by the NAB Accountholder.
"NAB Qantas Gold American Express Card" is the American Express Card/s issued in connection with the NAB Account.
"Prize" means the prize described in clause 10.
"Prize Draw" means the prize draw described in clause 8
"Prize Winner" means an Eligible Entrant whose valid entry is drawn to win a Prize under these Conditions of Entry.
"Promoter" means National Australia Bank Limited ABN 12 004 044 937, Level 34, 500 Bourke Street, Melbourne VIC 3000 (telephone 13 22 65)
"Promotional Material" means a letter from the Promoter to the relevant Eligible Entrant containing details of this promotion which is enclosed with a new NAB Qantas Gold American Express Card.
"Promotional Period", for an Eligible Entrant, is the period during the Competition Term, commencing on the date that is specified in the Eligible Entrant's Promotional Material and running for 30 days.
"Purchase" has the meaning given in the NAB Qantas Credit Card Account Reward Terms and Conditions.
- Information on how to enter and all Prize details form part of the terms and conditions of entry ("Conditions of Entry"). Entry into the promotion or acceptance of a Prize is deemed acceptance of these Conditions of Entry.
- The promotion commences at 00.01 (Melbourne time) on 1 February 2009 and closes at 23.59 (Melbourne time) on 30 June 2009 ("Competition Term").
- Entry is only open to Eligible Entrants.
- An Eligible Entrant will not be eligible to receive a Prize:
- if their NAB Account is closed or in default (as defined in the terms and conditions applicable to the NAB Account, and including (without limitation) if they have failed to make any minimum payments owing in respect of their NAB Account by the due date for that payment), at any time before the date the Prize is to be awarded; or
- if, by the date the Prize is to be awarded, they have not (whether before, during or after the Competition Term) joined the Qantas Frequent Flyer program as a member and provided to the Promoter their valid Qantas Frequent Flyer program membership number and such other membership details as the Promoter requires to award the Prize.
- Any Eligible Entrant who makes three or more Eligible Purchases will automatically receive one entry into the Prize Draw.
- Each Eligible Entrant can have a maximum of one entry into the Prize Draw.
- The Promoter accepts no responsibility for lost, delayed or misdirected transactions
- The prize draw will take place at 10:00am (Melbourne time) on 15 July 2009 at Beinteractive, Level 9, 155 George Street, Sydney, New South Wales 2000. All Prize winners ("Prize Winners") (and Back-Up winners as provided in clause 10) will be selected in accordance with clause 10. Entries will be drawn electronically at random. The result of each draw is final and no correspondence will be entered into.
- An entry is only valid if it is made by an Eligible Entrant and complies with these Conditions of Entry. No Eligible Entrant will receive a Prize except in accordance with these Conditions of Entry.
- There are four prizes. The first four valid entries drawn will each be awarded one Prize of 500,000 Bonus Qantas Frequent Flyer points ("Prize Points"). Prize Points are subject to, and governed by, the Terms and Conditions of the Qantas Frequent Flyer program.
Back Up Winner Details if required
The 5th to 20th Eligible Entrants drawn (inclusive) will be held as Back-Up Winners. Back-Up Winners will be recorded in the order drawn and used only in the instance that the Prize Winner is ineligible, and therefore unable to receive the Prize. The Prize will be awarded to the Back-Up winner in the order in which they were drawn. A Back-Up winner will not receive the Prize, except pursuant to this clause. - The notional value of each Prize is up to $12,070.00based on the awards that could be obtained by redeeming the Prize Points through the Qantas Frequent Flyer program (as more fully defined in the Terms and Conditions of the Qantas Frequent Flyer program, ‘Awards') as at 12 January 2009. For example, 500,000 Qantas Frequent Flyer points could be redeemed for: (i) five return Qantas Economy Classic Award flights between Sydney and Los Angeles (subject to Award flight availability) excluding applicable surcharges, fees and taxes; and (ii) one return Qantas Economy Classic Award flight between Sydney and Melbourne (subject to Award flight availability) excluding applicable surcharges, fees and taxes. The total prize value for this promotion is therefore $48,280.00.
- The prize value will also vary depending on the applicable Award flight(s) and/or other Qantas Frequent Flyer Award(s) chosen by the Prize Winners when redeeming the Prize Points. The number of Classic Award seats available is limited and availability depends on the flight, date, season and destination and some flights may not have any Classic Award seats available.
- The Promoter does not accept any responsibility or liability for any variation in the value of the Prizes or any inability to redeem the Prize Points.
- The use or redemption of Qantas Frequent Flyer points is subject to the availability of Awards at the time of booking. A passenger will not accrue Qantas Frequent Flyer points on Awards obtained through the redemption of any Prize Points.
- The Prize does not include surcharges, fees and taxes payable in cash for any Award under the Qantas Frequent Flyer program, travel insurance, passports, visas, spending money, meals, accommodation, transfers, taxes, ground transportation and any other costs of a personal nature not stated. Compliance with any health or other government requirements is the responsibility of the Prize Winners and any travel companion(s). Without limiting the above, entry into any country and satisfying any customs or related requirements is the full responsibility of the Prize Winners. Award travel is subject to the fare rules and the Conditions of Carriage of the relevant carrier. All Award travel is at the risk of the Prize Winners and any nominated travel companion(s) of the Prize Winners. The Promoter and Qantas Airways Limited make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade.
- Subject to these Conditions of Entry, if the Promoter is unable to provide any Prize Winner with the nominated Prize or any part of the Prize, for any reason, including the fact that any Prize Winner has not accepted their Prize within sufficient time to enable them to receive the Prize, the Promoter reserves the right to supply an alternative Prize of similar monetary value.
- The Prize Winners will be contacted in writing and telephone by the Promoter (at the contact details held by the Promoter for the NAB Account) within two days of the Prize Draw. The promoter will confirm whether the Prize Winner is eligible to win under these Conditions of Entry. The details of eligible Prize Winners will be published in The Australian newspaper on 22 July 2009.
- Where a Prize Winner complies with these Conditions of Entry (including without limitation clause 4), their Prize Points will be credited to their Qantas Frequent Flyer membership account by the Promoter on or before 30 October 2009. The prize is deemed to have been claimed once this credit occurs.
- Subject to applicable law:
- if any Prize Winner does not meet the requirements of clause 4 or is otherwise ineligible to receive a Prize under these Conditions of Entry, the Prize Winner will be deemed to have forfeited his/her prize; and
- if necessary, an unclaimed Prize draw will take place to re-allocate any forfeited Prizes, at the same place and time as the original Prize Draw on 4 November 2009, and will be conducted by Beinteractive.
- Any unclaimed Prize draw winners will be notified by phone and mail within 2 days of the unclaimed prize draw and have their details published in The Australian newspaper on 11 November 2009
- The promoter's decision is final and the promoter will not enter into correspondence regarding the Competition result.
- Neither the Promoter, Qantas Airways Limited, their related bodies corporate, nor their respective officers, employers, contractors or agents shall be liable for any loss or damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained (whether or not due to the negligence of any person) in connection with any entrant's or Prize Winner's participation in the Promotion or the receipt or use of any part of a Prize except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
- To the fullest extent permissible at law each entrant and each Prize Winner releases the Promoter, Qantas Airways Limited, their related bodies corporate, and their respective officers, employers, contractors and agents from any claim, loss, damage, expense (including, without limitation, any claim for legal expenses), cost, liability or charge sustained and/or in any way incurred by them in connection with a Prize and/or their participation in the promotion.
- If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion
- The Promoter cannot provide advice on specific tax issues. The Promoter recommends that Prize Winners seek independent tax advice and legal advice on any tax implications arising from winning a Prize. In the event that any Prize is subject to tax, the Promoter will not be liable for any additional tax payable by any Prize Winner.
- By accepting a Prize, Prize Winners agree to participate in any publicity arrangements made by or on behalf of the Promoter in relation to this Promotion. In addition to its rights under clauses 17 and 20, the Promoter reserves the right to publicise each Prize Winner's name, suburb, date of win and photograph through newsletters, print media, electronic media, broadcasts or any other means of publicity.
- Entrants consent to the Promoter using their personal information held by the Promoter, and disclosing it to its agents and suppliers, to the extent required to conduct the competition and award Prizes. Be.interactive Pty Ltd, on behalf of the Promoter, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Be.interactive Pty Ltd for this purpose. If you are not willing for this to occur you cannot participate in the Promotion. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
