Conditions of Entry:

Definitions

“NAB Facility”
means the NAB Commercial Card Facility or Velocity NAB Business American Express® Card Account applied for by the NAB Facility Holder and approved by NAB.
“NAB Facility Holder”
means a person who has applied for a NAB Facility and who received the Promotional Material during the Promotion Period.
“Establishment Date”
means the date the NAB Commercial Card Facility or Velocity NAB Business American Express® Card Account is established by NAB.
“Eligible Transaction”
means any transaction debited to the NAB Facility during the Promotion Period, including purchases and cash advances (including transfers to other NAB or non-NAB accounts) but not fees and charges (including government fees and charges).
“Promoter”
means National Australia Bank Limited ABN 12 004 044 937.
“Promotion Period”
means the period between 1st September 2007 at 12:00 AM (EST) and 31st May 2008 at 11:59PM (EDST).
“Promotional Material”
means the direct mail piece (and any supporting collateral) included in the NAB Commercial Card Welcome Pack sent to the business address of the NAB Facility Holder by the Promoter.
“Relevant Prize Draw”
means the relevant Prize draw described in 6.
  1. Information on how to enter and all Prize details form part of the terms and conditions of entry (“Conditions of Entry”). Entry is open to an eligible NAB Facility Holder:
    1. Who is a resident of Australia, over the age of 18 years and has received the Promotional Material. Employees and their immediate families of the Promoter, its subsidiaries and its agencies associated with this promotion are ineligible to enter. Employees of Belong Pty Ltd ABN 75 058 774 593 (“Belong”) who are directly involved in this promotion are also ineligible to enter; and
    2. who makes 20 (twenty) or more Eligible Transactions within 60 (sixty) days from the Establishment Date (inclusive) of the NAB Facility; and
    3. Whose NAB Facility is still open on the date of the Relevant Prize Draw
  2. An eligible NAB Facility Holder whose NAB Facility has been debited with 20 (twenty) Eligible Transactions within 60 days from the Establishment Date (inclusive), will automatically receive one entry only into the immediately following Relevant Prize Draw.
  3. An eligible NAB Facility Holder will not be eligible for any Prize if at the time of the relevant Prize draw:
    1. their NAB Facility is in default as defined in the terms and conditions applicable to their NAB Facility; or
    2. They have failed to meet all minimum payments on any relevant statement of account applicable to the NAB Facility by the due date.
  4. The Promoter accepts no responsibility for delayed or misdirected transactions.
  5. During the Promotional Period the Relevant Prize Draws are as follows:
    • December 2007 Prize draw - for Eligible Transactions debited to the NAB Facility between 1st September and 30th November 2007 (inclusive). This Prize draw will take place at Belong on 17th December 2007 at 11:00AM (EST) at Level 8, 155 George Street, Sydney NSW 2000.
    • March 2008 Prize draw - for Eligible Transactions debited to the NAB Facility between 1st December 2007 and 29th February 2008 (inclusive). This Prize draw will take place at Belong on 17th March 2008 at 11:00AM (EDST) at Level 8, 155 George Street, Sydney NSW 2000.
    • June 2008 Prize draw – for Eligible Transactions debited to the NAB Facility between 1st March and 31st May 2008 (inclusive). This Prize draw will take place at Belong on 16th June 2008 at 11:00AM (EDST) at Level 8, 155 George Street, Sydney NSW 2000.
  6. By accepting a Prize, a Prize Winner agrees to participate in any publicity arrangements made by or on behalf of the Promoter in relation to this Promotion. The Promoter reserves the right to publicise the Prize Winner’s name, suburb, date of win and photograph through newsletters, print media, electronic media, broadcasts or any other means of publicity. The details of Prize Winners will be published in the Australian newspaper on the following dates:
    • December 2007 Prize draw – 24th December 2007
    • March 2008 Prize draw – 24th March 2008
    • June 2008 Prize draw – 24th June 2008
  7. The Prize Winners (and Back-Up Winners) for all draws will be selected at random electronically. Judges’ decision is final and no correspondence will be entered into.
  8. Subject to these Conditions of Entry: The 1st eligible NAB Facility Holder drawn in the Relevant Prize Draw will win the Prize described in 9.
    1. The 2nd to 6th eligible NAB Facility Holders drawn (inclusive) in the Relevant Prize Draw will be held as Back-Up Winners. Back-Up Winners will be recorded in the order drawn and used only in the instance that the relevant Prize Winner is ineligible, and therefore unable to receive a Prize. The Prize will be awarded to the Back-Up Winner in the order in which they were drawn. A Back-Up Winner will not receive the Prize, except pursuant to this clause. Backup Winners are held in reserve for one Prize draw only and will be drawn separately for each of the three Prize draws.
    2. No NAB Facility holder will receive a Prize except in accordance with these Conditions of Entry.

  9. The Prize awarded at each Relevant Prize Draw is as follows:

    1 x 5, 000 gift card to either Officeworks or Bunnings Warehouse.
    The Prize Winner has the choice of gift card. The amount cannot be split between the Officeworks and Bunnings Warehouse.

    The total maximum prize value for the Promotion is $15,000

    The Prize will be delivered at the Promoter’s expense to the Prize Winner’s business address as held with the Promoter, within 14 days of the Prize Winner accepting the Prize.

  10. The Prize (including any part of the Prize) is not transferable, divisible or exchangeable and cannot be redeemed for cash. The gift card is subject to conditions of use defined by Officeworks and Bunnings Warehouse. The Promoter accepts no responsibility for any variation in the value or content of a Prize.
  11. Subject to these Conditions of Entry, if the Promoter is unable to provide any Prize Winner with the nominated Prize or any part of the Prize, for any reason, including the fact that any Prize Winner has not accepted their Prize within sufficient time to enable them to receive the Prize, the Promoter reserves the right to supply an alternative Prize of similar monetary value. Subject to state legislation.
    1. The Prize Winners will be contacted in writing and by telephone by the Promoter (at the contact details held by the Promoter for the NAB Facility within 5 business days of the Prize allocation:
      1. to notify the Prize Winner that his/her name has been successful in the promotion;
      2. to confirm whether the Prize Winner is eligible to win under these Conditions of Entry;
      3. to confirm whether the Prize Winner wishes to claim his/her prize; and
    2. The Prize Winner must confirm their eligibility under the Conditions of Entry and claim the Prize within 3.5 months of being notified that he/she is the Prize Winner.
  13. If any Prize Winner fails to comply with clause 12(b) (and subject to these Conditions of Entry) the Prize Winner will be deemed to have forfeited his/her prize. A re-allocation of the Prize to a Back-Up Winner will then be conducted at the same place and time as the original Prize draw on the following dates to award the forfeited Prize:
    • December 2007 Prize draw – 15th April 2008
    • March 2008 Prize draw – 15th July 2008
    • June 2008 Prize draw – 15th October 2008
    The Prize Winners of these re-allocations will be notified by phone and mail and results published in The Australian newspaper on the following dates:
    • December 2007 Prize draw – 30th April 2008
    • March 2008 Prize draw – 30th July 2008
    • June 2008 Prize draw – 30th October 2008
  14. Once an eligible NAB Facility Holder has been entered into a Relevant Prize Draw, that NAB Facility Holder is ineligible for any other Prize draw. This is regardless of whether or not the NAB Facility Holder is a Prize Winner or Back-Up Winner, or whether a NAB Facility Holder is later ruled ineligible in accordance with these Conditions of Entry.
  15. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any entrant’s or Prize Winner’s participation in the Promotion or the receipt or use of any part of a Prize except for any liability which cannot be excluded by law.
  16. To the fullest extent permissible at law each NAB Facility Holder and each Prize Winner releases the Promoter from any claim, loss, damage, expense (including, without limitation any claim for legal expenses), cost and charge sustained and/or in any way incurred by them in connection with a Prize and/or their participation in the Promotion.
  17. The Promoter cannot provide advice on specific tax issues. The Promoter recommends that independent tax advice and legal advice on any tax implications arising from winning a Prize should be sought. In the event that any Prize is subject to tax, the Promoter will not be liable for any additional tax payable by a Prize Winner.

Abridged Conditions of Entry

The Promoter is National Australia Bank Limited. Promotion Period ends 31/05/08 at 23:59 (EST).

To be eligible for entry, the NAB Facility Holder whose NAB Facility has been debited with 20 Eligible Transactions within 60 days from the Establishment Date (inclusive), will automatically receive one entry only into the immediately following Relevant Prize Draw. Relevant Prize Draws will take place on 17/12/07 at 11:00 (EST), 17/03/08 at 11:00 (EST), and 16/06/08 at 11:00 (EST) at Belong Level 8, 155 George St, Sydney NSW 2000. Promoters use of Information

The Promoter (National Australia Bank Limited) will be using your existing customer details to enter you in this competition ("Information"). The Information will be used by the Promoter to conduct this competition. Please contact the Promoter if you would like to access or correct the Information that the Promoter holds about you. The Promoter will generally provide you with access to your Information if practicable (although a fee may be imposed).
