Conditions of Entry
1) Information on how to enter and all prize details form part of the terms and conditions of entry ("Conditions of Entry"). By entering the promotion, entrants accept these Conditions of Entry.
2) Entry is only open to Australian residents who purchase a NAB Cash Passport Card subject to the provision of identification details as required). Employees of the Promoter, its subsidiaries and agencies associated with this promotion are ineligible to enter.
3) The promotion commences at 9.00am (AEST) Monday 3 July 2006 and closes at 8.00pm (AEST) Monday 31 July 2006 ("Promotional Period").
4) To be eligible for the prize draw entrants must purchase a NAB Cash Passport Card during the Promotional Period.
5) NAB Cash Passport Card holders will automatically be entered into the prize draw on purchasing a NAB Cash Passport Card during the Promotional Period.
6) Only one entry per person is permitted.
7) The prize draw will take place at Legion Interactive Pty Ltd (ABN 75 058 774 593) Level 8, 155 George St Sydney NSW at 10.00am AEST on Monday 7 August 2006. The Prize Winner will be selected at random electronically.
8) Judges' decision is final and no correspondence will be entered into. The prize is not exchangeable and cannot be taken as cash unless otherwise stipulated.
9) (a) The name of the Prize Winner will be published in The Australian newspaper on Friday 14th August 2006 and the Prize Winner will be contacted in writing and either by email, by phone, or SMS by the Promoter (at the contact details held by the Promoter for the Account) within 5 business days of the relevant draw:
(i) to notify the Prize Winner that his/her name has been drawn in the promotion;
(ii) to confirm whether the Prize Winner is eligible to win under these Conditions of Entry;
(iii) to confirm whether the Prize Winner wishes to have their name published in The Australian newspaper and claim his/her prize.
(b) The Prize Winner must confirm their eligibility under the Conditions of Entry, claim his/her prize within 5 business days of being notified that he/she is a Prize Winner, provided that if the Prize Winner is a resident in South Australia or Australian Capital Territory at the date of the relevant prize draw, such Prize Winner may claim his/her Prize within 3.5 months of the draw.
Subject to these Conditions of Entry there is one prize to be one and the first valid entry drawn will win a $10,000 travel voucher flying with the Promoter's chosen airline.
The Promoter accepts no responsibility for any variation in the value or content of the prize. If the Promoter in unable to provide any winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value, subject to state legislation.
10) All other expenses, including spending money, meals, travel to and from departure point, transfers, travel insurance and all other ancillary costs is the responsibility of the Prize Winner. Incidental charges charged to the Prize Winner's room, such as meals, mini bar, laundry room services, telephone calls etc are at the expense of the Prize Winner.
11) In the event that for any reason whatsoever the Prize Winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the Prize Winner and cash will not be awarded in lieu of that element of the Prize.
12) The total maximum potential value of the prize as at the date of publication of these Conditions of Entry is AUD 10,000.00.
13) The Promoter cannot provide advice on specific tax issues. The Promoter recommends that independent tax advice and legal advice on any tax implications arising from winning the Prize should be sought. In the event that any is subject to tax, the Promoter will not be liable for any additional tax payable by the Prize Winner.
14) The Promoter is not responsible for any incorrect or inaccurate information, either caused by website users or by any of the equipment or programming associated with or utilised in this competition, or by any technical error that may occur in the course of the administration of this competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
15) The prize must be claimed by Thursday 17 August 2006 (for all states except South Australia and Australian Capital Territory) and if the prize is unclaimed, forfeited or the entrant does not meet the Conditions of Entry, the Promoter reserves the right to a redraw on Monday 21 August 2006 at the same time and place as the original draw (subject to any written directions given under all State Regulations). The Prize Winner under this clause will be notified by mail, and will be awarded the prize subject to these Conditions of Entry. Results of such further draws (if necessary) will be published in The Australian newspaper on Friday 28 August 2006.
16) Should the original winner be from South Australia or the Australian Capital Territory and the Promoter is unable to contact them, the original prize will be forfeited. An unclaimed prize draw will take place on Tuesday 12 December 2006 at the same time and place as the original draw subject to Reg 37 of the Lotteries and Gaming Act 1993 (SA) at which time the Promoter will offer a similar prize or cash in lieu of the original prize (as per the original prize except for the date specific components of the prize). The Prize Winner under this clause will be notified by mail, and will be awarded the prize subject to these Conditions of Entry. Results of such further draws (if necessary) will be published in The Australian newspaper on Tuesday 19 December 2006.
17) The Promoter reserves the right to vary the rules of any competition or the prize offered or cancel any competition if it is no longer able to run the competition due to reasons beyond its control, subject to state legislation. The Promoter will not be liable for any losses to any party arising from any variation or cancellation.
18) The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the entrant's or Prize Winner's participation in the Promotion or the receipt or use of any part of the prize except for any liability which cannot be excluded by law.
19) To the fullest extent permissible at law the Prize Winner releases the Promoter from any claim, loss, damage, expense (including, without limitation any claim for legal expenses), cost and charge sustained and/or in any way incurred by them in connection with the prize and/or their participation in the Promotion.
20) By accepting the prize, the Prize Winner agrees to participate in any publicity arrangements made by or on behalf of the Promoter in relation to this Promotion. The Promoter reserves the right to publicise the Prize Winner's name, suburb, date of win and photograph through newsletters, print media, electronic media, broadcasts or any other means of publicity.
21) The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
22) This Promotion is a game of chance. All entries with a valid selection will form part of that random draw.
