NAB ATM Promotion conditions of entry

  1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
  2. Entry is only open to Australian residents aged 18 or over who:
    1. own a residential property in Australia that they reside in, or live with the owner of a residential property in Australia (and have received consent from the owner of the property to participate in this competition);
    2. do not have a criminal record (that in the Promoter’s opinion would deter them from participating in this competition);
    3. do not reside with any person who has a criminal record (that in the Promoter’s opinion would deter the entrant and that person from participating in this competition);
    4. are of good fame and character (as determined by the Promoter in its absolute discretion);
    5. are able to participate in all aspects and stages of the competition during the Competition Period and any on other dates as nominated by the Promoter; and
    6. will reside in the property referred to in paragraph (a) for the required periods up to 31 October 2011.
    Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with this competition are ineligible to enter. The winner must be able to accept the prize and participate in all associated requirements as specified by the Promoter and outlined in paragraph 14.
  3. The competition begins at 12:30pm (AEST) on 18/07/11 and closes at 4:59pm (AEST) on 31/08/11 (Competition Period).
  4. There are 3 Phases of this competition. Entrants must successfully pass each Phase in order to progress in the competition.
  5. Phase 1 - 5 To enter Phase 1 of the competition, entrants must, during the Competition Period:
    1. visit www.nab.com.au/loungeroomATM (Website); and
    2. fully complete and submit the online application form including by:
      • providing their full name, residential address, phone number, email address, gender and age; and
      • answering any questions regarding their dwelling and living arrangements and other matters as set out on the application form (and any other information as required by the Promoter).
  6. Entrants’ personal details will be used by the Promoter and third parties in accordance with paragraph 37.
  7. The answers provided by entrants on the online application form in Phase 1 will determine (in the Promoter’s absolute discretion) whether the entrant will move on to the next phase of the competition.
  8. If the Promoter determines (in its absolute discretion) that an entrant has successfully met the Phase 1 criteria (based on the answers provided in the Phase 1 application form), the entrant will be sent an email inviting them to enter Phase 2 of the competition and explaining the Phase 2 entry process. By entering this competition, entrants consent to receiving this electronic message from the Promoter. Entrants who are deemed by the Promoter to not be suitable to proceed to the next phase of the competition will be notified at the time of submitting their entry.
  9. Phase 2 - To enter Phase 2 of the competition, entrants who have received the Phase 2 invitation email from the Promoter must, during the Competition Period, respond to the following question “Why should NAB choose you to have an ATM in your lounge room?” by either:
    1. sending an email to loungeroomATM@nab.com.au containing a written submission to the question, accompanied by a visual image; OR
    2. sending by email to loungeroomATM@nab.com.au a link to an online audio-visual (video) submission created by the entrant representing or illustrating their response to the question(Phase 2 Entry).
  10. Email max size 10MB. Video max size 100MB; max length 5 minutes; acceptable formats AVI, MOV, WMV, MP4, MPEG, FLV, 3GP, and 3G2).
  11. By entering Phase 2, entrants acknowledge that their Phase 2 Entry (along with their name) will be made available online by the Promoter (in its absolute discretion) and accessible by the general public. Entrants acknowledge that they will not be compensated for any use of their name or other details, or for use of any part of their entry into any phase of this competition. The Promoter may copy, in part or in its entirety, any Phase 2 Entry, cause any Phase 2 Entry to be seen and heard in public, edit any Phase 2 Entry and communicate any Phase 2 Entry to the public and broadcast through mainstream media. It may also allow third parties to do these things.
  12. At the end of the Competition Period, the Promoter will judge each Phase 2 Entry and will shortlist the Phase 2 Entries that it deems (in its absolute discretion) to be the best from all Phase 2 Entries received. The shortlisted Phase 2 Entries will progress to the Phase 3 Finalist stage of the competition.
  13. Phase 3 Finalists - Between 5 and 14 September 2011, the Phase 3 Finalists (subject to the Promoter conducting a police check on the Phase 3 Finalist) will be required to take part in an audition at their house whereby the Promoter will attend the Phase 3 Finalists home on a date and for a duration to be specified by the Promoter. Phase 3 Finalists must be available to take part in this audition on the date and for a duration specified by the Promoter. Each Phase 3 Finalist agrees to allow the Promoter and its subcontractors to enter their home for the purposes of conducting a building/site inspection, determining the suitability of the residence for the installation of an ATM and for determining the general brand and character suitability of the residence and the Phase 3 Finalist (and, where applicable, of the Phase 3 Finalist’s household members). Wherever possible, the other household members of the Phase 3 Finalists should also attend the audition.
  14. Prize - There is one prize to be won. The Phase 3 Finalist deemed to be the best and most suitable (in the Promoter’s absolute discretion) stemming from the Phase 3 Finalist auditions will win the prize. The winner will be deemed to be the individual whose name was specified on the winning Phase 3 Finalist’s Phase 1 online application form.
  15. In the event that the Promoter deems (in its absolute discretion) that there is no “best and most suitable” Phase 3 Finalist, there will be no winner in this competition and the Promoter reserves the right to audition alternative candidates who have not entered this competition in order to distribute the prize.
  16. The prize is $1,000 credit (to be placed in a NAB Classic Banking account in the winner’s name) to facilitate ATM transactions, an iPad2 valued at $839 (inc GST) and an iPhone4 valued at $999 (inc GST) set up to facilitate online banking. If the winner has an existing NAB Classic Banking account in their name, the $1,000 will be deposited to that account. If the winner does not have an existing NAB Classic Banking Account in their name, they will be required to visit a NAB branch to open a NAB Classic Banking Account within the time specified by the Promoter, in which case standard account opening procedures, including identification and verification checks, will apply. Where applicable, once the NAB Classic Banking Account has been opened in accordance with these terms and any additional terms which apply to the account, the Promoter will deposit the $1,000 into the winner’s new NAB Classic Banking Account. Standard terms and conditions apply to use of the account, which are available at any NAB branch, along with information about any fees and charges. The winner will also have an NAB ATM installed in their lounge room between 21 September and 3 October 2011 to allow the winner to withdraw money from their NAB banking account at any time during that period. As part of accepting this prize, the winner agrees to the following:
    1. signing, and procuring any household member or visitor to sign, a confidentiality agreement as provided by the Promoter and any third parties;
    2. signing , and procuring any household member or visitor to sign, any agreements or forms (provided by the Promoter) in relation to the installation of the ATM as reasonably required by the Promoter in favour of all parties involved in this competition and/or providing the prize prior to taking the prize. If the winner or any household member or visitor does not sign the agreements/forms provided by the Promoter within the time requested by the Promoter, the winner’s entry or claim may be deemed invalid;
    3. seek all necessary Body Corporate approvals (if applicable) prior to installation of the ATM and providing evidence of such approvals to the Promoter in the time requested by the Promoter;
    4. allowing the Promoter’s approved subcontractors to access the winner’s house for the purposes of installing, maintaining and dismantling the ATM between September and October 2011 (exact dates to be specified by the Promoter);
    5. having a sensor activated camera installed in the winner’s home (next to the ATM). The winner understands that the filmed footage will be used in accordance with paragraph 28;
    6. having a “fake wall” installed by the approved subcontractors in the winner’s house with the ATM for the purpose of housing the ATM;
    7. allowing a film crew to access the winner’s house for the purpose of filming the winner and other residents of the winner’s house for 2 days (4 and 5 October 2011, or other dates as specified by the Promoter). The winner understands that the filmed footage will be used in accordance with paragraph 28;
    8. signing a talent and location agreement as provided by the Promoter and any third parties (and having the residents and visitors of the winner’s house sign the talent agreement where requested by the Promoter);
    9. having such security measures (which may include armed guards) put in place as agreed between the winner and the Promoter;
    10. allowing armed security guards (if necessary) or any other third parties (as authorised by the Promoter) to access the ATM for auditing/maintenance purposes at various times as notified by the Promoter;
    11. not allowing any other person other than themselves or other persons living in the winner’s house to access and use the ATM (unless, where required by the Promoter, such persons have signed an agreement in favour of the Promoter and any third party specified by the Promoter); and
    12. complying with any other conditions or requirements regarding the installation, maintenance and use of the ATM as specified by the Promoter.
  17. General conditions - The Promoter will cover all reasonable costs associated with any damage caused to the winner’s property as a result of the installation, maintenance and dismantling of the ATM. The Promoter will also cover all reasonable costs associated with any damage caused to the winner’s property caused by the film crew, security guards or any subcontractors engaged by the Promoter between September and October 2011. Any damage caused to the ATM by the winner or other residents or visitors of the winner’s house is the responsibility of the winner.
  18. Entries are limited to one entry per person. All Phase 1 and Phase 2 entries must be received by the Promoter during the Competition Period. Entries are deemed to be received at the time of receipt by the Promoter’s database and not at the time of submission by an entrant. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses or aliases may be disqualified.
  19. The Phase 3 Finalists (and their household members) must comply with all directions provided in relation to the auditions, and each Phase 3 Finalist understands that their audition will be filmed and used in accordance with paragraph 28.
  20. This competition is a game of skill; chance plays no part in determining the successful entrants in each phase or the overall winner. The winner will be selected based on their creativity, suitability of residence (for the purposes of installation requirements), fame and character and brand suitability. The judges' decisions are final and no correspondence will be entered into.
  21. Entries not fully complying with these conditions of entry (including but not limited to if an entrant is not able to take part in the Phase 3 Finalist auditions on dates to be confirmed by the Promoter) may be deemed invalid at the Promoter’s discretion.
  22. Entrants agree to sign, and procure all of their household members and visitors to sign, any consent forms or other documents or agreements that the Promoter may require. Without limitation, this includes any forms, documents or agreements required in order to assess the winner’s (or any of the winner’s household members’ or visitors’) fame and character, including by giving the Promoter (or a third party on the Promoter’s behalf) permission to obtain police reports as required.
  23. Each entrant assigns all rights (including copyright) in their Phase 2 Entry to the Promoter at the time of submitting their Phase 2 Entry. By entering this competition, Phase 2 entrants:
    1. consent to the Promoter making copies of or publishing the whole or any part of their Phase 2 Entry and otherwise exploiting the Phase 2 Entry and any rights in relation to the Phase 2 Entry, to publicise this competition, the Promoter’s products and services or for any other purposes;
    2. consent to the Promoter allowing third parties to exploit the Phase 2 Entry, including (without limitation) in advertisements and promotional activities;
    3. undertake to the Promoter that their Phase 2 Entry is not, and its use by the Promoter and its licensees will not be, in breach of any third party intellectual property rights; and
    4. consent to any act by the Promoter or its licensees in relation to their Phase 2 Entry which would otherwise infringe their moral rights in the content of the Phase 2 Entry.
  24. If an entrant elects to withdraw their entry from the competition, the entrant forfeits their right and opportunity to participate in this completion and to all associated prizes in respect of that entry.
  25. The Promoter, in its absolute discretion, may edit any part of an entrant’s Phase 2 Entry for advertising purposes. By entering, entrants agree to the Promoter editing, amending, making an adaptation of or otherwise varying the whole or any part of their Phase 2 Entry for advertising purposes.
  26. By entering this competition, each entrant warrants that their Phase 2 Entry:
    1. is original and not copied, and was created by the entrant;
    2. does not include any image of, or voice of, any other person in the visual or audio-visual content without that person’s express consent;
    3. does not include any content that contravenes any law, infringes the rights of any person or is obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate. Without limitation, entrants must not include any content that involves nudity, malice, swearing or which may be defamatory or in contempt of court;
    4. does not include any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists (Copyright Content), unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any Copyright Content (for example, recorded music) in their Phase 2 Entry, they must not include it. By including any Copyright Content in their Phase 2 Entry, the entrant warrants that they are entitled to do so; and
    5. contains no viruses or other computer code or material embedded in it which may have a negative impact on the NAB website, this competition or any network or third party computer systems.
  27. The Promoter may (but is not obliged to) at any time reject and/or remove from access by the public or disqualify or invalidate any entry that it considers (in its sole judgment) infringes these conditions of entry. The Promoter will have no liability to entrants in that regard.
  28. Entrants must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize (or completing/passing a Phase), free of charge, and they consent to the Promoter and third parties authorised by the Promoter using their name and image in promotional material.
  29. The prize must be claimed by 20 September 2011. If the prize remains unclaimed by this date, that winner’s entry will be deemed invalid and the Promoter reserves the right to award the prize to the next best Phase 3 Finalist (if any) or in accordance with paragraph 15.
  30. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  31. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to the iPad2 or iPhone4 prize.
  32. Entrants may, at the Promoter’s request within the time specified by the Promoter, be required to provide proof of identity, proof of age, proof of residency and proof of current living arrangements to verify whether an entrant fits the eligibility criteria set out in these conditions of entry. Identification and proof considered suitable for verification of eligibility is at the Promoter’s discretion. Failure to provide such proof and identification within the time specified by the Promoter will deem the entrant to be invalid.
  33. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person. The Promoter may in its absolute discretion cancel the prize or otherwise cease to provide any benefit of the prize to the winner if the winner (or any of the other residents of the winner’s house), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, which damages or threatens to damage any property of the Promoter or its agencies or contactors, is contrary to law or is otherwise inappropriate.
  34. The prizes are not transferable or exchangeable and cannot be redeemed for cash (unless cash is specified). In the event for any reason the winner does not take the prize at the time stipulated by the Promoter then the prize will be forfeited by the winner and cash will not be supplied in lieu. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
  35. If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.
  36. The Promoter is not liable for any tax implications arising from the prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  37. All entries will be the property of the Promoter. Without limiting paragraph 22, the information entrants provide will be used by the Promoter for the purpose of conducting this competition and communicating with entrants. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants, and as otherwise contemplated by these conditions. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
