Conditions of Entry:
Definitions
"NAB Account"means the NAB credit card account applied for by the NAB Accountholder.
"NAB Accountholder" means a person who has applied for a NAB Account and who received the Promotional Material during the Promotion Period.
"Eligible Transaction" means any transaction debited to the new NAB Credit Card account during the Promotion Period, including purchases and cash advances (including transfers to other NAB or non-NAB accounts) but not annual and account fees or other bank fees, credit charges, government fees and charges. Also excluded are transactions which are disputed, fraudulent or involve abuse of your NAB Credit Card account.
"Promoter" means National Australia Bank Limited ABN 12 004 044 937, 800 Bourke Street, Docklands VIC 3008
"Promotion Period" means the period between 15th April 2008 at 00:01 (EST) and 30th November 2008 at 23:59 (EDST).
"Promotional Material" means the direct mail piece (and any supporting collateral) included in the credit card welcome pack accompanying the NAB credit card sent to the postal address of the NAB Accountholder by the Promoter.
"Relevant Prize Draw" means the relevant Prize Draw described in 6.
- Information on how to enter and all Prize details form part of the terms and conditions of entry (“Conditions of Entry”).
- Entry is open to a NAB Accountholder:
- who is a resident of Australia, over the age of 18 years and has received the Promotional Material. Employees of NAB and Belong Pty Ltd ABN 75 058 774 593 (“Belong”) are ineligible to enter, as are NAB Accountholders whose new NAB Account has been allocated by NAB because of a lost card or a change/upgrade to their NAB credit card account; and
- who makes 10 (ten) or more Eligible Transactions within 60 (sixty) days of the date of the letter entitled “Credit Card Details” in which NAB offered the NAB Account to the NAB Accountholder; and
- whose NAB Account is still open on the date of the Relevant Prize Draw.
- A NAB Accountholder whose NAB Account has been debited with 10 (ten) Eligible Transactions within 60 days of the date of the letter entitled “Credit Card Details” in which NAB offered such NAB Account, will automatically receive one entry into the immediately following Relevant Prize Draw.
- A NAB Accountholder will not be eligible for any Prize if at the time of the relevant Prize Draw:
- their NAB Account is in default as defined in the terms and conditions applicable to their NAB Account; or
- they have failed to meet all minimum payments on any relevant statement of account applicable to the NAB Account by the due date.
- The Promoter accepts no responsibility for delayed or misdirected transactions.
- During the Promotional Period the Relevant Prize Draws are as follows:

August Prize Draw - 10 Eligible Transactions need to be debited to the NAB Account within 60 days of the date of the letter entitled “Credit Card Details”, with the 10th transaction debited by the 31st July 2008.This Prize Draw will take place at Belong on 8th August 2008 at 10am (EST) at Level 8, 155 George Street, Sydney NSW 2000.

December Prize Draw - 10 Eligible Transactions need to be debited to the NAB Account within 60 days of the date of the letter entitled “Credit Card Details”, with the 10th transaction debited by 30th November 2008. This Prize Draw will take place at Belong on 8th December 2008 at 10am (EDST) at Level 8, 155 George Street, Sydney NSW 2000.
- The Prize Winners (and Back-Up Winners) for all Draws will be selected at random electronically. Judges’ decision is final and no correspondence will be entered into.
- Subject to these Conditions of Entry:
- the 1st eligible NAB Accountholder Drawn in the Relevant Prize Draw will be a Prize Winner and receive AU$5,000 credited by NAB to their NAB Account as detailed below;
- the 2nd to 6th eligible NAB Accountholders Drawn (inclusive) in the Relevant Prize Draw will be held as Back-Up Winners. Back-Up Winners will be recorded in the order Drawn and used only in the instance that the relevant Prize Winner is ineligible, and therefore unable to receive a Prize. The Prize will be awarded to the Back-Up Winner in the order in which they were drawn. A Back-Up Winner will not receive the Prize, except pursuant to this clause. Backup Winners are held in reserve for one Prize Draw only and will be drawn separately for each of the two Prize Draws.
- no NAB Accountholder will receive a Prize except in accordance with these Conditions of Entry.
- The Prize awarded at each Relevant Prize Draw is as follows:
AUD$5,000 credited by NAB to the Prize Winner’s NAB Account by 30th September 2008 for the August Prize Draw and by 31st January 2009 for the December Prize Draw.
The total maximum potential value for the Promotion at the date of publication of these Conditions of Entry is AU$10,000.
The credit by NAB is not deemed a payment to the NAB Account. The Prize winner’s must still pay the ‘minimum payment’ required by the applicable Account terms and conditions.
- The Prize (including any part of the Prize) is not transferable, divisible or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in the value or content of a Prize.
- Subject to these Conditions of Entry, if the Promoter is unable to provide any Prize Winner with the nominated Prize or any part of the Prize, for any reason, including the fact that any Prize Winner has not accepted their Prize within sufficient time to enable them to receive the Prize, the Promoter reserves the right to supply an alternative Prize of similar monetary value. Subject to state legislation.
- (a) The Prize Winners will be contacted in writing and by telephone by the Promoter (at the contact details held by the Promoter for the NAB Account) within 5 business days of the Prize allocation:
- to notify the Prize Winner that his/her name has been successful in the promotion;
- to confirm whether the Prize Winner is eligible to win under these Conditions of Entry;
- to confirm whether the Prize Winner wishes to claim his/her prize; and
(b) The Prize Winner must confirm their eligibility under the Conditions of Entry and claim the Prize within 3 months of being notified that he/she is the Prize Winner.
- If any Prize Winner fails to comply with clause 12(b) (and subject to these Conditions of Entry) the Prize Winner will be deemed to have forfeited his/her prize. An unclaimed prize draw will take place to re-allocate the forfeited Prize, at the same place and time as the original Prize Draw on the following dates:
The Prize Winners of these re-allocations will be notified by phone and mail and results published in The Australian newspaper on the following dates:
- Once a NAB Accountholder has been entered into a Relevant Prize Draw, that NAB Accountholder is ineligible for any other Prize Draw. This is regardless of whether or not the NAB Accountholder is a Prize Winner or Back -Up Winner, or whether a NAB Accountholder is later ruled ineligible in accordance with these Conditions of Entry.
- The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any entrant’s or Prize Winner’s participation in the Promotion or the receipt or use of any part of a Prize except for any liability which cannot be excluded by law.
- To the fullest extent permissible at law each NAB Accountholder and each Prize Winner releases the Promoter from any claim, loss, damage, expense (including, without limitation any claim for legal expenses), cost and charge sustained and/or in any way incurred by them in connection with a Prize and/or their participation in the Promotion.
- The Promoter cannot provide advice on specific tax issues. The Promoter recommends that independent tax advice and legal advice on any tax implications arising from winning a Prize should be sought. In the event that any Prize is subject to tax, the Promoter will not be liable for any additional tax payable by a Prize Winner.
- By accepting a Prize, a Prize Winner agrees to participate in any publicity arrangements made by or on behalf of the Promoter in relation to this Promotion. The Promoter reserves the right to publicise the Prize Winner’s name, suburb, date of win and photograph through newsletters, print media, electronic media, broadcasts or any other means of publicity. The details of Prize Winners will be published in the Australian newspaper on the following dates:
