NAB Auskick TVC Conditions of Entry

NAB AUSKICK TVC PROMOTION (“Promotion”) National Australia Bank Limited (“NAB”) (“Promoter”) CONDITIONS OF ENTRY AFL Authorisation Number: GFAFL08/58
  1. Information on How to Enter and Prizes form part of these Conditions of Entry.
  2. The Entrant is responsible for ensuring his or her familiarity with the Conditions of Entry at the time of participation. Entry into this Promotion is deemed to be acceptance of these Conditions of Entry. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of the Conditions of Entry generally.
  3. The Promotion is only open to “Eligible Entrants”, being individuals who:
    1. I. are residents of Australia aged 18 years and older (including NAB employees who are not directly associated with this Promotion); and
    2. are a parent/guardian of a registered NAB AFL Auskick Participant; and
    3. are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of a NAB employee directly associated with this Promotion; and
    4. have not won a Prize/Prizes valued either individually or collectively at more than $5,000 from the Promoter, or in any promotion run by the Promoter, in the prior 12 months; and
    5. have not been discovered to have used or attempted to use any more than one name in order to qualify to win any contest run by the Promoter except in the case of a legal change of name; and
    6. have not been discovered to have breached Conditions of Entry of previous contests run by the Promoter.
  4. All entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded the prize to the ineligible person. Return of a prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.
  5. The Promoters decision in relation to any aspect of the Promotion is final and binding on every person who enters. No correspondence will be entered into.
  6. All prices stated are in Australian dollars, represent the Recommended Retail Price (RRP) and include GST. All references to times and dates are to times and dates in Melbourne, which may be Australian Eastern Standard Time (AEST) or Australian Eastern Daylight Time (AEDT) depending on the date. All times are stated using the 24 hour clock.

    Key Dates

  7. The Promotion commences 30 May 2008 at 09:00 am and concludes 20 June 2008 at 11:59 pm (“Promotion Period”).
  8. There are two components to this Promotion. A Prize Draw and the Photo Competition.
  9. The Prize Draw will be held at 12 noon on 07 July 2008 at Prime Focus 104/55 Beach Street Port Melbourne 3207. The first valid entry randomly drawn will win a Trip to the 2008 Toyota AFL Grand Final (“Grand Final Trip”).

    Photo Competition

  10. The Photo Competition will involve the judging of all photos received and will occur from 24-27 June 2008, final judging to occur on the 27 June 2008. Five (5) photos will be chosen, including one (1) photo from a NAB Employee. The winning photos selected will form part of an audition for the next NAB Auskick Television Commercial (“TVC Audition”). This component of the Promotion is based on a game of skill where chance plays no part in determining the winners. Each valid entry received will be judged by a panel of judges (Creative Agency, NAB representatives and the Television Commercial Director (“Director”)), on, among other criteria, a certain look that the Director is after to create the Television Commercial. Three children out of the five photos selected will participate and star in the new NAB AFL Auskick commercial.
  11. All entrants selected from the Photo Competition for the TVC Audition will be notified in writing and by phone.
  12. The NAB AFL Auskick Participants selected to be a part of the TVC Audition must be confirmed by 27 June 2008 and need to be available to attend the TVC Audition in Melbourne between 10 - 11 July 2008. If not available that participants’ entry will be discarded and the prize will be awarded to the next best valid entry that has not already received the opportunity to be a part of the TVC Audition.
  13. If an entry selected is deemed not to comply with these Conditions of Entry, that entry will be discarded and a new entry will be chosen/drawn.

    Unclaimed Prize Draw:

  14. The Grand Final Trip must be claimed by 29 August 2008 (for all States and Territories except South Australia (SA)) and if the Grand Final Trip remains unallocated or unclaimed, a further draw will be conducted on 01 September 2008 at the same time and place as the original draw (subject to any written directions given under all State Regulations). In the event of a winner as part of the Unclaimed Prize Draw, their details will be published in the Public Notices section of The Australian on 19 September 2008.
  15. Should the original Grand Final Trip winner be from SA and the Promoter is unable to contact them, the original prize will be forfeited. An unclaimed prize draw will take place on 01 October 2008 at the same time and place as the original draw subject to Reg 37 of the Lotteries and Gaming Act 1993 (SA) at which time the Promoter will offer cash up to the total maximum value of the prize in lieu of the Grand Final Trip. In the event of a winner is nominated as part of the unclaimed prize draw, their details will be published in the Public Notices section of The Australian on 29 October 2008.

    HOW TO ENTER

  16. To enter log onto www.nab.com.au/tvstar and click on “Enter Now” which will open an application form where Eligible Entrants are asked to send in a photo of their current NAB AFL Auskick registered child in their footy gear along with their name, phone number, address, state, Auskick centre and child’s name. Eligible NAB Staff are required to state “NAB Employee” as part of their entry in the name field. All entrants submitting photo entries will be entered into both the Grand Final Trip Prize Draw and the Photo Competition. There is a limit of one (1) photo per entry and one (1) entry per NAB AFL Auskick registered child. The Promoter acknowledges that one Eligible Entrant could have more than one NAB AFL Auskick registered child. Any cost associated with accessing the Promotion website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. GRAND FINAL TRIP
  17. The first valid entry randomly drawn from all entries received will win a 2008 Toyota AFL Grand Final Trip valued at up to $4,500 (inc GST) depending on the Winners permanent place of residence. The Grand Final Trip is for the NAB AFL Auskick participant and their parent or guardian and consists of:
    1. return economy airfares for two (2) to Melbourne from the Australian State or Territory Capital City nearest to the Winners’ place of residence.
    2. airport transfers whilst in Melbourne;
    3. three (3) nights accommodation (twin share) at Carlton Crest Hotel (or equivalent hotel) in Melbourne;
    4. all main meals while in Melbourne;
    5. two (2) tickets to attend the 2008 Toyota AFL Grand Final on 27 September 2008;
    6. an invitation for the eligible child to play in the NAB AFL Auskick game at half time of the 2008 Toyota AFL Grand Final on 27 September 2008;
    7. an invitation for the eligible child to participate in the 2008 Toyota AFL Grand Final Parade on 26 September 2008; and
    8. an invitation to attend a welcome dinner on 25 September 2008.
    If the Grand Final Trip winner permanently resides in Victoria, flights and airport transfers are not included and the winner will be responsible for making their own way to the accommodation, at their own expense.
  18. The Grand Final Trip does not (except as expressly stated) include:
    1. I. any transport between the Winners residence and the departure airport; or
    2. any overnight accommodation while traveling to the departure airport or destination; or
    3. any other travel or accommodation; or
    4. any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages); or
    5. any insurance (such as travel or health cover) however the Promoter may require them to sign a waiver prior to travel; or
    6. any other ancillary costs which may be incurred by those traveling on The Grand Final Trip.
  19. The Grand Final Trip Winner must hold a valid credit card and present this on check in at accommodation, to cover any incidental hotel charges.
  20. All components of the Grand Final Trip must be taken together as a single trip booked by the Promoter or Associated Entity. Travel must be taken at the time specified by the Promoter and must coincide with the dates of the scheduled activities forming part of the trip. Once booked changes to the traveler details, travel, flights or accommodation arrangements can not be made.
  21. The Grand Final Trip Winner will be published in the Public Notices section of The Australian on 30 July 2008.

    Photo Competition: TVC AUDITION

  22. The five (5) best photos chosen from all photos received, as determined by the judges will each have the opportunity to take part in an audition for the next NAB AFL Auskick Television Commercial. This audition is scheduled from 10 - 11 July 2008 and will take place in Melbourne. Meals will be provided while at the TVC Audition. The Director will choose from the audition recording which participants will be included in the NAB AFL Auskick Television Commercial due to be aired from 02 August 2008. Each NAB AFL Auskick Participant chosen will also receive a $1000 NAB Smart Junior Saver account.
  23. With respect to participants chosen for the TVC Audition who do not permanently reside in Victoria (“Non-Victorian Winners”) the Promoter will provide the NAB AFL Auskick participant and their parent/guardian the following travel package (“TVC Travel Package”):
    1. return economy airfares for two (2) to Melbourne from the Australian State or Territory capital city nearest to the Winners’ place of residence;
    2. airport transfers whilst in Melbourne;
    3. two (2) night accommodation (twin share) at Carlton Crest Hotel (or equivalent hotel) in Melbourne;
  24. The TVC Travel Package does not (except as expressly stated) include:
    1. I. any transport between the Winners residence and the departure airport; or
    2. any overnight accommodation while traveling to the departure airport or destination (if required); or
    3. any other travel (including travel to the TVC Audition) or accommodation; or
    4. any other meals;
    5. any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages); or
    6. any insurance (such as travel or health cover) however the Promoter may require them to sign a waiver prior to travel; or
    7. any other ancillary costs which may be incurred by those traveling to the TVC Audition.
  25. Non-Victorian Winners must hold a valid credit card and present this on check in at accommodation, to cover any incidental hotel charges.
  26. Travel and accommodation must be taken at the time specified by the Promoter and must coincide with the dates of the scheduled TVC Audition. Once booked changes to the traveler details, travel, flights or accommodation arrangements can not be made.
  27. If a winner chosen permanently resides in Victoria, flights and airport transfers are not included and the winner will be responsible for making their own way to the TVC Audition, at their own expense.
  28. Total value for the TVC Audition is up to $10,000 (depending on winners permanent place of residence).
  29. If for any reason a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  30. If any element of a prize is unavailable for any reason the Promoter reserves the right to substitute that element for one of equal or greater value, subject to State regulation.
  31. The Prize Winner(s) and any NAB AFL Auskick Participants selected for the TVC Audition must, at the Promoter’s request, participate in all Promotional activity (such as the Television Commercial, publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name, image and/or footage in any Promotional material.
  32. All entries are deemed to be received at the time of receipt in the Promotion database and NOT time of transmission by the Entrant.
  33. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, delayed, misdirected or corrupted entries whether due to error, omission, alteration, deletion, destruction, transmission interruption, communications failure or otherwise.
  34. The Promoter assumes no responsibility for:
    1. any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise;
    2. any theft, destruction or unauthorized access to, or alteration of such communications;
    3. any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion;
    4. any incorrect or incomplete information which may be communicated in the course of the administering this Promotion.
  35. The Promoter reserves the right to request winners to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
  36. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements or photographs.
  37. The Promoter may, at its absolute discretion, disqualify any Entrant/s and declare any or all entries made by an Entrant/s invalid if the Entrant/s:
    1. Tampers with the entry process, including the use of any automated entry software or any other mechanical or electronic means that permit the Entrant to automatically enter repeatedly; or
    2. Tampers with the operation of the Promotion or web site; or
    3. Is found to be using multiple aliases, household addresses or email addresses; or
    4. Acts in a disruptive manner; or
    5. Fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction; or
    6. Fails to produce items as required or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or
    7. Acts in violation of these Conditions of Entry.
  38. To the full extent permitted by law (in which case that liability is limited to the minimum allowable by law), the Promoter, its Associated entities exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant, Prize winners/NAB AFL Auskick Participants or in connection with the Promotion or prizes, including:
    1. any indirect, economic or consequential loss;
    2. any loss arising from the negligence of a Relevant Party;
    3. any liability for personal injury or death.
  39. Prize Winners must, if requested by the Promoter, agree to and sign:
    1. an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize and/or participate in the prize; and
    2. a liability release, waiver and/or indemnity, in a form determined by the Promoter and in favour of the Promoter and/or any person or other entity associated with this Promotion.
    A person who does not comply with this condition forfeits their prize and/or right to participate in the prize
  40. Winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.
  41. If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion, subject to the approval of the authorities that have issued permits for its conduct.
  42. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.

    PERSONAL INFORMATION

  43. All entries become the sole property of the Promoter. The photo entries must be the entrant’s original work and entrants undertake that their photo entries is not, and its use by the Promoter or Associated Entities will not be, in breach of any other person’s intellectual property rights. Entrants agree that the Promoter and Associated Entities may contact them for a higher quality resolution photo, make copies of the photo, and/or publish it on the Website/Intranet or elsewhere.
  44. The personal information entrants provide will be used by the Promoter, and may be disclosed to its agents, to conduct the Promotion.   45. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
